By creating an account or using TESTD ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and TESTD, Inc. ("we," "us," or "our"). We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
You must be at least 18 years old to use TESTD. By using the Service, you represent and warrant that you are 18 years of age or older. If we learn that a user is under 18, we will immediately terminate their account.
TESTD is a personal safety and health transparency platform. It allows users to voluntarily share their STI testing status, set safety check-in timers, and discover nearby TESTD users via Bluetooth Low Energy proximity.
TESTD is not a medical service. We are not a healthcare provider, laboratory, or medical device. Nothing on TESTD constitutes medical advice, diagnosis, or treatment. Always consult a licensed healthcare professional for medical decisions.
TESTD does not verify the authenticity of test results uploaded by users. We display what users submit. You are responsible for evaluating the credibility of information you receive through the Service.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@testd.app if you suspect unauthorized access to your account.
You may not create accounts on behalf of others, use false information to create an account, or transfer your account to another person.
By using TESTD, you agree that you will not:
You are solely responsible for the accuracy of any health information you upload or self-report on TESTD. Uploading false test results or misrepresenting your health status may expose you to legal liability and is a violation of these Terms, which may result in immediate account termination.
TESTD does not independently verify uploaded documents. Share Links display the information you provide as-is. Recipients of your Share Links should exercise their own judgment.
The Safety Check-In feature allows you to set a timer and designate trusted contacts to be notified if you do not check in before the timer expires. By using this feature, you authorize TESTD to contact your designated trusted contacts on your behalf via email or SMS.
You are responsible for ensuring your trusted contacts have consented to receive these communications. TESTD is not liable for any failure to deliver alerts due to incorrect contact information, carrier issues, spam filters, or technical failures.
The Safety Check-In feature is a convenience tool and is not a substitute for emergency services. If you or someone else is in immediate danger, call 911 or your local emergency number.
The Nearby feature uses Bluetooth Low Energy to broadcast an anonymous health status signal to nearby TESTD users. Broadcasting is off by default and must be explicitly enabled by you in Settings.
When enabled, your device broadcasts an anonymized signal that does not include your name, email, or user ID. You can disable broadcasting at any time. TESTD is not responsible for how nearby users interpret or act on proximity signals.
Share Links allow you to share your health status with specific individuals. Anyone in possession of a Share Link can view the information you chose to include. Share Links may have expiry dates you configure. You can revoke a Share Link at any time from the Links page.
Once you share a link, you cannot control whether the recipient has saved or screenshot the information. Share Links responsibly.
TESTD and its original content, features, and functionality are owned by TESTD, Inc. and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.
You retain ownership of any content you upload to TESTD. By uploading content, you grant TESTD a limited license to store and display that content solely for the purpose of providing the Service to you.
We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if we determine your use of the Service poses a risk to other users or to TESTD.
You may delete your account at any time via Settings → Danger Zone. Upon deletion, your personal data, health results, share links, check-ins, and trusted contacts will be permanently removed.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TESTD DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
WE EXPRESSLY DISCLAIM ALL WARRANTIES RELATED TO THE ACCURACY OR COMPLETENESS OF HEALTH INFORMATION SUBMITTED BY USERS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TESTD, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO HEALTH DECISIONS MADE BASED ON INFORMATION SHARED THROUGH THE PLATFORM.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Dallas County, Texas.
